It emphasizes open communication, transparency, and cooperation between both parties to resolve issues such as child custody, asset distribution, and support payments, in a way that minimizes conflict and emotional stress.

The process typically involves a series of joint sessions where both spouses and their lawyers, as well as financial neutrals and mental health process facilitators, work together to reach an agreement that is fair for everyone.

If the collaborative process breaks down and no agreement can be reached, the lawyers involved are required to withdraw from the case, and the spouses must seek new representation for litigation, reinforcing the commitment of all parties to find a resolution out of court.
